在这篇文章当中,笔者将主要对于地皮征收的一整个流程进行分析,借此来展现出我国有关的法律条文现在仍然存在的一些问题,并且希望在分析完成后的基础之上找到改变及完善的方法。在进程观察研究以及分析之后,笔者认为地皮征收这种行为对于社会来说,它并不单单是一种简单的政府行政行为,更多的是双向性的一种协调行为。本文旨在希望社会个体在面临地皮征收时能够冷静下来寻求正当的法律保护。希望个人能够遵循正当的法律途径,以消除法律“灰色地带”为原则揭开违背或模糊解释民事原则的不合理规定,从而在最大程度上为自己争取到应有的合法权益。而且在笔者进程走访及调查的过程当中发现了许多并不特殊的暴力拆迁案例,这分明就是政府公权对与自然人私权的严重侵犯,就这个问题笔者也简单地提出了几点建议。
In this article, I will mainly analyze the whole process of land expropriation to show some problems that still exist in our country’s relevant legal provisions, and I hope to find changes and improvements on the basis of the analysis Methods. After observing and analyzing the process, the author thinks that it is not only a simple government administration behavior but also a two-way coordinated action for the society. The purpose of this article is to hope that individuals in society can calm down and seek proper legal protection in the face of land expropriation. It is hoped that individuals will follow proper legal channels and uncover the unreasonable provisions that violate or vaguely interpret the civil principle in the principle of eliminating the law and the “gray area”, so as to obtain the due legitimate rights and interests for the greatest extent. In addition, during the process of the author’s visit and investigation, many cases of violent demolition were uncovered. This is a clear violation of the government’s right to private individuals with natural persons. I also made a few suggestions on this issue.
