当前我国军事征用法制建设坚持实践推动、体现权威强制、强调层次关联、注重完善发展,但仍然存在着专门法典缺失、法律关系不清、定义表述不明、征用范围界定模糊、征用时效没有确定等问题。为进一步推进法制建设,应进行军事征用的专门立法、确定补偿主体、明确补偿细节。
However, there are still some problems such as the lack of a special code, unclear legal relationship, unclear definitions, ambiguous scope of expropriation, and uncertain time-lapse of expropriation, etc. At present, the legal construction of military requisition in our country adheres to the principle of promoting practice, imposing authority coercion, emphasizing the level correlation and focusing on perfecting development . In order to further promote the legal system construction, special legislation on military expropriation should be carried out to determine the subject of compensation and clarify the details of compensation.
