“盘查是警察攻势勤务的一种,其目的是维护公共秩序,保护社会治安,防止和消弭一切危害和犯罪,从而充分发挥警察应有的职能。”~①世界各国都有类似我国盘查的规定,将其作为警察维护社会治安秩序的法定职能而派生出来的一项法定职权。~②各国均对这些措施设立了实体要件和程序要件,针对不同的种类给予不同的限制。但审视我国的盘查制度,可以发现法律对盘查的规定较为混乱和分散,盘查制度在法律资源、理论廓清、实践操作方面都存在一些问题。从人权保障和警察执法效果的角度看,盘查措施的
