事实判断之儒家立场和成文法之法家性质的矛盾导致西汉疑狱、春秋决狱应时而生。西汉经学背景为春秋决狱提供人才、受众等因素,形成决狱运作实施的结构成分和政治环境。以董仲舒为代表的公羊派通过创造性地阐释《春秋》经义,实现了“贵志”原则在决狱中的致用。在具体的运作过程中,春秋决狱采取比附推理逻辑,这虽然不利于法律规范体系的发展,却在一定程度上实现了汉代法律价值体系的建构。
The contradiction between the Confucian position of fact judgment and the legal nature of statutory law led to the suspicion of Western Han Dynasty and the establishment of the Spring and Autumn Annatations. The Western Han Confucian classics provide talents, audiences and other factors for the Spring and Autumn Prison to form the structural elements and political environment for the operation of the prison. The Gongyang School, represented by Dong Zhongshu, realized the application of the principle of “nobleness” in the prison by creatively explaining the “Spring and Autumn” Jingyi. In the concrete operation process, the Spring and Autumn prisoner adopts the logic of affixation of reasoning, which, although not conducive to the development of legal norms system, has to some extent realized the construction of legal value system in the Han Dynasty.
