刑法上意义上的平等包括一律平等和排除特权两方面含义,然而,平等并不意味着绝对的平等,在刑事立法司法过程中要对不同类别加以区别对待,以实现实质上的平等。
Equality in the criminal law includes both equality and exclusion. However, equality does not mean absolute equality. Different categories should be treated differently in the process of criminal law and justice in order to achieve substantive equality.
