补充性管辖原则是指当一国国内的司法系统不能正常、合理地运作,从而使得该国难以有效地对国际犯罪行使管辖权时,由国际刑事法院或国际法庭行使管辖权的管辖制度。区际刑事管辖冲突是指由于一国存在不同的社会制度、法律体系,导致不同地区在对同一犯罪行为行使管辖权时发生冲突。我国当前的刑事管辖冲突主要表现为大陆、香港和澳门三地区之间的刑事管辖冲突。补充性管辖原则的本土化是解决我国区际刑事管辖冲突的有效手段。
The principle of complementary jurisdiction refers to the system of jurisdiction exercised by the ICC or the International Tribunal when the domestic judicial system can not function normally and reasonably so as to make it difficult to effectively exercise jurisdiction over international crimes. Interregional criminal jurisdiction conflict refers to the existence of different social systems and legal systems in one country, resulting in conflicts in different regions when exercising jurisdiction over the same crime. The current conflict of criminal jurisdiction in our country mainly manifests as the conflict of criminal jurisdiction between the three continents in mainland China, Hong Kong and Macao. Localization of Supplementary Jurisdiction Principle is an Effective Means to Solve Conflict of Interregional Criminal Jurisdiction in Our Country.
