本文欲从公民合法权益的保障方面来探讨网络警察权力的分配、约束。笔者将从消极与积极两个方面来阐述以上问题。消极方面主要涉及网络警察权力的约束,以致网络警察在行使权力时不侵犯公民的合法权益。这包括从立法方面规范网络违法犯罪行为的类型与构成。积极方面包括网络警察的权力应当对网络空间中所发生侵犯民事权利的救济方面有所扩充与分配。
This article tries to discuss the distribution and restraint of cyber police power in terms of the protection of citizens’ legitimate rights and interests. The author will elaborate on the above issues from both negative and positive aspects. Negative aspects mainly involve the restriction of cyber police power so that cyber police do not infringe the legitimate rights and interests of citizens when exercising their power. This includes the type and constitution of regulating online criminal activities in terms of legislation. The positive aspects, including the power of cyber police, should be expanded and distributed to remedy infringement of civil rights in cyberspace.
