笔者从农用地转用的征收补偿和增值收益分配的现状、存在的问题和完善调控机制的迫切性,探讨相应的法律措施。由于转变经济发展方式、保障粮食和生态安全,实现可持续发展和保障农民合法权益的迫切需要严格界定公益性建设用地;公益性建设用地的征收、征用补偿标准,在按照被征收征用土地的原用途给予补偿的基础上适当调高;对经营性建设用地申请农用地转用的程序,应按照行政许可法的规定设定更为详尽的实施程序;建立经营性建设用地的增值收益分配机制和经营性建设用地的产权处理方式。
