一、引言随着检察改革的深入推进,检察机关的内外部监督制约机制不断完善。特别是最高人民检察院在全国试点实行人民监督员制度,通过社会公众参与检察机关的具体办案环节,实行社会民主监督。由于该制度还在试点阶段,许多理论与实践问题还亟待深入研究。目前,一些学者在开展比较研究时,将研究的视野集中在美国的大陪审团制度、日本的检察审查会制度方面,认为这些都是民众参与检察或公众参与司法的典型制度,并提出人民监督员制度完善建设。笔者认为,相关研究应当更多地关注一些国家和地区反贪机构的外部社会监督制度,系统研究职务犯罪侦查权的外部社会监督,才能提出完善人民监督员制度的建议。
I. Introduction With the further promotion of procuratorial reform, the internal and external supervision and restriction mechanisms of procuratorial organs have been continuously improved. In particular, the Supreme People’s Procuratorate piloted the implementation of the system of people’s supervisors throughout the country and implemented social democratic supervision through the participation of the general public in the prosecution’s handling of cases. Since the system is still in the pilot stage, many theoretical and practical issues still need further study. At present, some scholars focus their research on the grand jury system in the United States and the system of procuratorial censors in Japan when conducting comparative studies. These scholars think that these are the typical systems of public participation in procuratorial or public participation in the judiciary and put forward the people’s supervision Staff system perfect construction. The author believes that the relevant research should pay more attention to the external social supervision system of the anti-corruption agencies in some countries and regions and systematically study the external social supervision of the investigation right of the official crime so as to put forward the suggestions of perfecting the people’s supervisor system.
