英国著名法律史学家梅因曾说过,“现代化离不开对传统的利用与改造,最现代的法制也有古代法的影响”。中国法律传统是中国古代法律文化长期聚集的结果,它包含了中国传统法律文化的基本精神。法制现代化是对传统法律文化的批判继承和更高阶段的综合与创新,是传统法律文化的必然发展。全盘否定传统法律文化是不可能走向现代化的。因此,在现代化法制建设中重审法律传统,汲取其精华,弃其糟粕,做到古为今用,提取法律传统中适应现代化社会生活的合理部分,对法制现代化的建设大有裨益。本文从传统道德、团体本位以及传统吏治等方面阐述法律传统在现代化法制建设中意义。
Maine, a famous British legal historian, once said: “Modernization can not be separated from the traditional use and transformation. The most modern legal system also has the influence of ancient law.” The Chinese legal tradition is the result of the long-standing accumulation of the legal culture in ancient China. It contains the basic spirit of the traditional Chinese legal culture. The modernization of legal system is the critical inheritance and the synthesis and innovation of the traditional legal culture, which is the inevitable development of the traditional legal culture. It is impossible to completely deny the traditional legal culture to modernization. Therefore, reviewing the legal tradition in the process of building a modern legal system, drawing on its essence and abandoning its dross, and making ancient uses today and extracting the reasonable parts of the legal tradition that adapt to the modern social life, are of great benefit to the modernization of the legal system. This article expounds the significance of legal tradition in the construction of modern legal system from the aspects of traditional morality, group standard and traditional official management.
