作为一种纯粹的的技术产物,网络犹如一把双刃剑,网络化的生活在拉近人们之间的距离,在提供前所未有的便利的基础上,也导致了诸多新问题的产生。2003年12月18日,我国首例盗窃网络虚拟财产案在北京朝阳区法院开庭审理,至此,网络虚拟财产首次进入了司法的视野,我国司法实务界和理论界也积极对网络虚拟财产展开了深入研讨。尽管我国现行法律还没有明确网络虚拟财产的法律定位,但是网络虚拟财产已被越来越多的人认可,网络虚拟财产案件也逐渐增多,虚拟财产已不是一个虚拟的问题了,而是一个迫切需要法律解决的现实问题。
