制度正义是以特定的历史条件和人性假设为前提的价值范畴,也是合规律性与合目的性的有机统一。从马克思主义人性论视角看,制度设计需要以人的自然性、社会性和精神性为基本前提,以促进人的自由全面发展为价值目标,通过制度正义安排,促进社会进步和人的发展。在制度设计与创新中,应当以特定的社会历史条件为逻辑起点、以人的价值需要为应然要求,建立公正合理的社会制度。
Institutional justice is a category of value based on certain historical conditions and humanistic assumptions, and is also an organic unity of conformity and purpose. From the perspective of Marxist theory of human nature, system design needs human nature, sociality and spirituality as the basic prerequisite to promote the free and all-round development of human beings as a value target and to promote social progress and human development through institutional justice arrangements. In the system design and innovation, we should regard the specific social and historical conditions as the logical starting point, take the human needs of value as the deserved request, and establish a just and reasonable social system.
