本文围绕澳大利亚为公共健康政策限制烟草商标使用而出台的《香烟简明包装法》展开论述。首先描述了该法对商标法基础理论的挑战及对TRIPS协定第20条要求的违背;其次介绍了商标权限制的一般原理;再次分析了澳大利亚限制商标使用是否符合TRIPS协定第8.1条的规定;最后作出总结表明我国可以考虑对烟草包装实行一定限制,但不应采取类似澳大利亚限制合法注册烟草商标所有人使用商标的做法。
This essay focuses on the “Concise Packaging of Cigarettes”, which is introduced by Australia to restrict the use of tobacco trademarks for public health policies. First of all, it describes the challenge of the law on the basic theory of trademark law and the violation of the requirements of article 20 of the TRIPS agreement. Second, it introduces the general principle of the restriction of trademark rights. Thirdly, it analyzes again whether Australia restricts the use of trademark in compliance with Article 8.1 of the TRIPS Agreement. A concluding summary shows that our country could consider some restrictions on tobacco packaging but should not adopt a practice similar to Australia’s restriction on the use of trademarks by owners of legally registered tobacco marks.
