当今社会,随着信息技术的飞速发展,电子网络已与人们的日常生活密不可分,以互联网为基础的全球电子商务交易平台也在这种形势下迅速发展和应用。国际电子商务贸易,是一种新兴的贸易方式,可以实现跨越国境的商品和服务的交换。但由于网络的虚拟性以及监管力度的缺乏,电子商务领域还存在着不少安全隐患,涉及到一些法律问题比如电子签名的有效性、网络第三方支付的安全性等。本文从国际电子商务的发展现状及趋势出发,通过对比国际组织及欧美等国在电子商务方面的立法模式,分析我国如何完善电子商务领域的立法,建立合理的法律体系,规制电子商务的运营。
In today’s society, with the rapid development of information technology, the electronic network has become inseparable from the daily life of people. The internet-based global e-commerce trading platform has also rapidly developed and applied under such circumstances. International trade in e-commerce is a new form of trade that allows for the exchange of goods and services across borders. However, due to the virtual nature of the network and the lack of supervision, there are still many potential safety issues in the field of e-commerce. Some legal issues such as the validity of electronic signatures and the security of third-party payment on the Internet are also involved. This essay starts from the development status and trend of international e-commerce. By comparing the legislative models of e-commerce in international organizations and Europe and the United States, this article analyzes how to perfect the legislation in the field of e-commerce, establish a reasonable legal system and regulate the operation of e-commerce.
