翻异别勘制度作为宋代司法中的重要制度,其主要价值在于对审判过程中造成的审理不公的问题进行纠错和驳正。本文通过历史文献对翻异别勘制度的内容、启动机制、运转流程以及相关案例进行分析探究,翻异别勘制度对现代公正司法建设有重要的借鉴价值。
As the important system in the judicial system of Song Dynasty, the main value lies in the correction and refutation of the unfair trial caused during the trial. In this paper, we analyze and investigate the content, starting mechanism, working process and related cases of the system of disagreement and reconciliation through historical documents. There is an important reference value for the construction of modern fair and justice judgments.
