由于反垄断法具有域外管辖效力,各国的反垄断法都有可能对中国企业的海外并购及设立合资企业产生重要影响。新年伊始,我国对境外企业价格垄断开出首张罚单,成为外资在华的首个重大新闻:韩国三星、LG,中国台湾地区奇美、友达等六家国际大型面板生产商,因垄断液晶面板价格,遭到国家发改委经济制裁3.53亿元人民币。这是迄今为止中国开出的金额最高的一张价格违法罚单,也是我国反垄断监管迈出的重要一步。 Due to the extraterritorial jurisdiction of the antitrust law, antitrust laws of all countries may have an important influence on the overseas mergers and acquisitions of Chinese enterprises and the establishment of joint ventures.
