新制度经济学是以交易费用为理论前提,以制度作为基础研究对象的新兴经济学学派。其中科斯定理和诺斯制度变迁等重要理论为冲突法的价值评价分析提供了一个全新的研究视角。冲突法的价值体系是由形式正义、实质正义、自由、秩序、效率等多元价值导向同构且相互作用的完整系统,各价值内涵间既相互共存又存在内在的博弈张力。在新制度经济学的理论框架下,通过对冲突法内在价值取向的多元整合,以达至冲突法形式正义与实质正义的主辅关系配比平衡;自由与秩序价值对立状态下相互依存的辩证统一;以及效率最优配置下私人利益与国家利益的协调兼顾。
The new institutional economics is based on transaction costs as the theoretical premise, the system as the basis for the study of emerging economics school. The important theories such as Coase Theorem and the North Institutional Change provide a brand new research perspective for the value evaluation of conflict law. The value system of conflict law is a complete system of isomorphism and interaction that is guided by multiple values of formal justice, substantive justice, freedom, order and efficiency. The connotations of values are both coexistent and inherently inherent in game tension. Under the theoretical framework of new institutional economics, through the multiple integration of the intrinsic value orientation of the conflict of laws approach, the balance of primary and secondary relations between the formal justice and the substantive justice of the conflict law can be reached; the dialectical interdependence between the values of freedom and the opposite state of value Unity; and the optimal efficiency allocation of private interests and the coordination of national interests.
