跨界环境损害事件近些年呈高发态势,亟待国际法的有效应对。国际法学界当前在跨界环境损害的概念界定问题上还存在模糊和分歧,成为跨界环境损害理论探索方面首先需要解决的难题。“跨界”概念的核心是主权国家的管辖与控制,全球公域排除在外。“环境损害”概念不限于引入性的环境污染,其他非引入性的环境不利后果亦包含在内。因此,“跨界环境损害”是一国管辖或控制下的地区内发生的环境污染或破坏,对另一国管辖或控制的地区所造成的重大不利后果,包括对人身、财产以及自然环境本身在内的任何损害。
In recent years, the incidence of cross-border environmental damage has been on the rise, and an urgent response to international law is urgently needed. At present, there is still vagueness and disagreement on the definition of the concept of transboundary environmental damage in the international jurisprudence field, which becomes the first problem to be solved in the exploration of theory of transboundary environmental damage.
