中国古代死刑复奏制度是一项具有中国特点的死刑执行制度。该项制度确立于北魏,定型于隋唐,完善于明清,体系完整,制度完备,功能明确,是中国古代司法实践经验的总结,是防止错杀无辜的一项完善的司法制度,其合理“内核”可为完善现代死刑执行程序提供有益的借鉴。
