《中华人民共和国物权法》已于2007年10月1日正式施行,该法在我国首次确立的预告登记制度亦成为不可忽视的亮点,这一制度的确立无论是在维护当事人权利还是在保障不动产交易安全方面,都具有里程碑式的意义。然而由于该项制度的立法过于粗疏,实践中不免存在难以施行之尴尬。笔者通过对这一制度的全面审视,不揣冒昧地指出了该项制度存在的诸多不足并有针对性地提出了一些解决问题的对策建议,以期这项崭新的制度能够顺利地得以实施并切实地发挥其应有的作用。
