第十二届全国人大常委会第十一次会议于2014年11月1日审议通过了《全国人民代表大会常务委员会关于修改〈中华人民共和国行政诉讼法〉的决定》,这是《行政诉讼法》实施20多年来的第一次大修。新《行政诉讼法》体现了当前深化司法体制改革的政策要求,在公民权利保护和规范行政权力运行方面,积极回应了行政法学理论界和实务界以及广大社会公众的关切,并针对“立案难、审理难、执行难”等突出问题增设了许多重大的新制度、新规定。然而,从法院审理行改案件、当事人参与诉讼的实际需要出发,新《行政诉讼法》中增设的新制度、新规定在一定程度上还只是一些原则性的规定,操作规程上还缺乏明确和细化。
