半年前,我丈夫在与同事李某等一起午餐后,虽然知道李某已有醉意,但为了不迟到,加之李某一再表示没事,最终仍搭乘李某的小车上班。岂料,途中恰恰遭遇小车与货车碰撞的交通事故,我丈夫被甩出车外,当场身亡。经交警部门认定,李某血液中酒精含量171.3mg/100ml,属醉酒驾车,且对前方来车动向判断失误,负事故的主要责任,对方司机负事故的次要责任,我丈夫在事故中无责任。事后,我曾向人力资源和社会保障局提出工伤认定申请,要求确认丈夫之死属于工伤。
