虽然我国创业板市场尚未建立,但是中国证监会已就创业板市场的上市条例,提出新的实施细则讨论稿。其细则规定有7类企业暂不准到创业板市场上市的条文。禁止创业板上市的企业有:①大型国有企业;②大型国有企业分拆部分资产和业务设立的公司;③已在主板上市的企业分拆部分资产和业务设立的公司;④有内部职工持股的定向募集公司;⑤有历史遗留问题的企业;⑥职工持股会直接或者间接持股的公司;⑦工会直接或者间接持股的公司。新的实施细则讨论稿,还规定对申请创业板市场上市的企业,发行前股本总额不得少于1000万元人民币,同时也
