【裁判要旨】对经营者出售的仅有卫食证字号而无保健食品批号或者假冒批准文号的产品,应视为普通食品。经营者出售该种食品如明知不符合食品安全标准的,应承担向消费者支付十倍赔偿金等民事责任。
The purpose of the referee The products sold by the operator that have only the card number without the health food batch number or the fake approval number should be regarded as ordinary food. If the operator sells this kind of food knowing that it does not meet the food safety standards, he shall bear the civil liability such as paying ten times of compensation to the consumers.
