劳务派遣是伴随着经济社会发展和市场化程度不断提高而逐渐产生的一种新型用工形式。本文利用新制度经济学中的契约理论来分析劳务派遣契约关系,认为劳务派遣的契约具有外部性、隐性契约和短期性的特点,这是造成派遣员工权益受侵的重要原因。因此,保护派遣员工的合法权益不仅要加强第三方强制力的约束,更重要的是要促进劳务派遣合约的自我履约。
Labor dispatch is a new form of employment that gradually emerges along with the continuous improvement of economic and social development and marketization. This article uses the contract theory in the new institutional economics to analyze the labor dispatch contractual relationship. It considers that the dispatch of labor dispatch has the characteristics of externality, implicit contract and short-term. This is the important reason that caused the dispatch of employee rights. Therefore, protecting the legitimate rights and interests of dispatched staff should not only strengthen the restraint of third-party coercion, but more importantly, promote self-compliance of labor dispatch contracts.
