社会主义经济转型期,房地产市场上存在大量违章建筑,使得理论界对其能否成为执行标的存在颇多争议。未必所有的违章建筑都必须予以拆除,甚至某些违章建筑可以通过补办手续获得所有权,从而取得稳定的社会价值、使用价值和合法财产权益的内容。本文结合执行工作实践,对违章建筑执行的必要性、可行性,以及执行方式等相关问题进行研究,以期对完善法院执行工作有所裨益。
In the period of socialist economic transformation, there are a lot of illegal structures in the real estate market, making theorists have a lot of controversies over whether they can become the subject of implementation. Not necessarily all the illegal buildings must be dismantled, and even some illegal buildings can get through the re-issue of ownership, so as to obtain a stable social value, value and legal property rights content. This article, combined with the implementation of work practices, studies the necessity, feasibility and implementation of illegal structures in order to improve the implementation of the courts.
