行政指导是市场经济发展过程中,特别是“二战”以来走上现代市场经济轨道后,世界各国关于民主理念、市场功能、政府角色、行政模式的辩证认识和政策选择不断演进的结果。中国的行政指导,也如其他国家或地区的行政指导一样,不仅存在于经济领域,而且还极其广泛地存在于非经济领域。由于目前这种“雄心勃勃的指导计划的指导行为”在大多数情况下仍处于事实状态,远未步入法治化轨道,法治行政原则面临严重威胁,使得无论是在理论上,还是在实践中都不可回避地提出有关行政指导的法律控制问题。
