现代法制社会的构建有赖于以法官为代表的司法者们,因此如何在每一桩案件中向民众传达法律理念是各国的治理者们必须思考的问题,以卡多佐为代表的美国经验主义司法哲学流派在长期的司法实践中强调要用能动的方式去发现法律生长的轨迹,反对单纯而机械的适用法律。本文试图以卡多佐的代表性著述《司法过程的性质》为例,剖析司法者的能动力对于阐释法律的意义所能带来的影响。
The construction of modern legal society relies on judges as the representatives of the judicial people, so how to convey legal concepts to the public in every case is a question that all the country’s managers must think about. This paper attempts to take Cardozo’s representative book “the nature of the judicial process” as an example to analyze the impact of judicial motivation on the interpretation of the meaning of law.
