法学理论是对法的原理、原则、价值、范畴和规律等法的基本问题的理性思考,对一个国家法律制度的发展走向起着重要作用。正确的法学理论可以引导法律制度向正确的方向发展,错误的法学理论则可能把国家法律制度甚至政治制度引向歧途。我国社会主义法学理论和其他各种各样的法学理论不同之处在于:一是坚持历史唯物主义的观点。作为上层建筑的法律是一定发展水平的经济基础的产物,法的发展必须同整个社会物质文明、精神文明和政治文明的发展相适应,法律永远不能超出社会经济条件所
The theory of law is a rational consideration of the basic problems of the law, principles, values, categories and laws, and plays an important role in the development of the legal system in a country. The correct legal theory can guide the legal system to the right direction. The wrong legal theory may lead the national legal system and even the political system to the wrong direction. The differences between the theories of socialism in our country and those of other jurisprudence lie in the following aspects: First, we uphold the viewpoints of historical materialism. The law of the superstructure is the product of the economic foundation of a certain level of development. The development of the law must be compatible with the development of material civilization, spiritual civilization and political civilization in the entire society. The law can never exceed the social and economic conditions
