本文围绕“潜产权”这一核心概念,在《从潜产权到产权———一种产权起源假说》一文的作者对潜产权作了细致阐述的基础上,将潜产权的定性修正为产权形成过程中的一个阶段。继而,关于潜产权的成因作了几点解释,并得出了潜产权的形成是多种因素的合力的结果这一结论。另外,考察了潜产权到产权转化的前提假设、路径、影响因素等问题。最后,阐述了关注潜产权的理论意义和现实意义,并且着重刻画了其对于有效防止我国国有资产流失的意义。
Based on the core concept of “potential property right”, this paper elaborates on the potential property rights on the basis of the detailed description of the potential property rights in the article entitled “From the property right to property - a hypothesis of the origin of property rights” A stage in the process. After that, it makes some explanations about the causation of potential property rights and concludes that the formation of latent property rights is the resultant of many factors. In addition, it examines the preconditions, paths, influencing factors and other issues of the conversion from the property rights to the property rights. In the end, it expounds the theoretical and practical significance of paying attention to the potential property rights, and emphasizes its significance for effectively preventing the loss of state assets in our country.
