定罪量刑并非法官简单地对照刑事法律规范进行的单向的、静态的过程,而是在罪刑法定原则的框架下,由法官、行为人、被害人、社会公众四元主体互动的动态过程。在此过程中,各方的互动关系分别表现为冲突、强制、合作,而情感因素则成为各种互动关系的纽带。在此基础之上,各方的情感因素有了“展示”的空间,并对定罪量刑过程、结果产生微妙影响。在定罪量刑过程中的互动过程中,各主体的情感因素的作用力划分则为:以行为人情感为基础,以法官情感为主导,以公众情感、被害人情感为参照、印证。
