器官移植手术是一项新兴的医疗技术,是现代医学发展带给人类的福音。然而器官移植手术在飞速发展的同时,也给人类自身带来了极大地挑战,其涉及到很多的伦理和法律问题。本文简要介绍了器官移植的历史和现状以及器官移植技术对于人类发展的意义,重点论述了关于器官移植的立法原则。通过对器官移植的认识和分析,总结出器官移植立法中应当遵循的基本原则:包括公平原则、知情同意原则、无偿原则、优先考虑供体利益原则、非优先性原则、技术准入原则。以期通过这些原则对器官移植的法律规制,避免法律纠纷的产生。
Organ transplant surgery is a new medical technology, which is the gospel brought to humankind by the development of modern medicine. However, with the rapid development of organ transplantation, human beings have also posed great challenges to themselves. They involve many ethical and legal issues. This article briefly introduces the history and current status of organ transplantation and the implications of organ transplantation for human development. It focuses on the legislative principles of organ transplantation. Through the understanding and analysis of organ transplantation, the basic principles that should be followed in organ transplantation legislation are summarized: fairness principle, informed consent principle, gratuitous principle, giving priority to donor interests, non-priority principle and technology admittance principle. With a view to legal regulation of organ transplantation through these principles, avoid the occurrence of legal disputes.
