科技不断发展,互联网在中国越来越普及,据不完全统计中国网民的数量已达到3亿多。各种交流平台的出现给予了网络谣言滋生的环境而且有着愈演愈烈之势。网络谣言具有极大的危害,它能侵犯个人名誉,能扰乱社会秩序,更有甚者能危害国家安全。刑法是规制网络谣言的重要手段。因此本文主要阐述网络谣言现象和目前我国刑法对其规制的缺陷同时提出了一些建议。
With the continuous development of science and technology, the Internet is becoming more and more popular in China. According to incomplete statistics, the number of netizens in China has reached over 300 million. The emergence of various communication platforms has given rise to a network of rumors of the environment and has become increasingly fierce. Internet rumors have great harm, it can infringe on personal reputation, can disrupt social order, and even worse can endanger national security. Criminal law is an important means of regulating online rumors. Therefore, this article mainly elaborates the network rumor phenomenon and the defect of our country’s criminal law to its regulation at the same time put forward some suggestions at the same time.
