我国《婚姻法》在结婚制度方面的规定不够完善,导致生活中某些特殊主体的婚姻或准婚姻行为无法得到确认和规制。我们应当适应社会发展和人们思想观念多元化变化的需要,通过专门立法,明确保护大学生在婚姻家庭方面的合法权益;将试婚问题归入道德规范调整范畴;对非婚同居予以适当的法律规制;实事求是地解决变性人的婚姻关系。 China’s “Marriage Law” in the marriage system is not perfect enough rules, leading to life in some special subject of marriage or quasi-marriage can not be confirmed and regulated. We should adapt ourselves to the needs of social development and diversified changes in people’s ideology and concepts, clearly protect the legitimate rights and interests of university students in marriage and family through special legislation, classify the trial marriage into the sphere of ethics regulation, and properly regulate non-marital cohabitation ; Seek truth from facts to solve transgender people’s marital relations.
