美国产品责任法是在英国产品责任判例基础上形成和发展起来的,但它的影响却超过了英国产品责任法,并且,在其严格产品责任制度形成后,对欧盟及欧盟各成员国包括英国的产品责任法产生了巨大影响,推动了美国和欧盟各国产品质量的提高。我国虽然有《民法通则》和《产品质量法》、《消费者权益保护法》等相关法律,但产品质量和产品责任问题已经成为一个非常突出的社会问题。因此,研究美国产品责任法的发展动态,并从中寻求启示,对进一步完善我国产品责任立法,具有重大现实意义。
The United States product liability law is formed and developed on the basis of British product liability jurisprudence, but its influence exceeds the British product liability law. And after its strict product liability system was formed, the EU and EU member states including the United Kingdom Product liability law had a tremendous impact, promoting the United States and EU countries to improve product quality. Although China has “General Principles of Civil Law” and “Product Quality Law”, “Consumer Protection Law” and other relevant laws, but product quality and product liability has become a very prominent social issues. Therefore, it is of great realistic significance to study the development of the product liability law in the United States and to seek enlightenment from it. It is of great practical significance to further improve the legislation on product liability in our country.
