2007年,颁布了重在保护公民合法私有财产的法律《中华人民共和国物权法》(以下简称《物权法》)给那些饱受拆迁行为侵权的人们带来了希望,但是现在公民的权益仍在遭受着暴力商业拆迁事件的侵犯。究其原因,在于现行的行政商业拆迁模式使拆迁方和被拆迁方处于一种不平等的地位。所以,在《物权法》颁布的背景下研究一种新型民事性商业拆迁模式,这是一种以实现民法中的契约自由、保护国民合法私有财产为目的,使商业拆迁中的拆迁方与被拆迁方于平等地位的新型房屋拆迁模式,是解决社会上的暴力商业拆迁侵权难题的关键所在。
