将自然科学研究中的理想状态原理借鉴于法学研究将有利于将一些复杂的法学理论问题简单化。本文运用理想状态原理对证据概念问题进行研究,将证据可以定义为能够证明案件情况的事实,证据的根本属性是实质正义应当具备的客观性和相关性,同时兼顾形式正义的程序价值,将具备客观性、相关性和合法性的证据称为理想状态的证据。
Drawing on the ideal state principle in natural science research for legal research will be conducive to simplifying some complicated legal theoretical issues. This paper uses the ideal state principle to study the concept of evidence. Evidence can be defined as the fact that can prove the situation of the case. The fundamental attribute of evidence is the objectivity and relevance that substantive justice should have. At the same time, taking into account the procedural value of formal justice, Evidence of objectivity, relevance, and legitimacy is called evidence of an ideal state.
