完善的矿山环境保护立法体系是遏制矿山环境污染、保障国家能源安全和促进可持续发展的重要基础。就法律表现形式而言,我国已初步形成了矿山环境保护法律体系框架,但尚未形成完善的矿山环境保护立法体系。本文通过对现有矿山环境保护法律规范的梳理、分析,综合比较不同立法模式的特点、优劣,提出了完善我国矿山环境保护立法体系的初步见解,即增设基本法、修订相关法、完善配套法及修制地方法。
A sound legal system for mining environmental protection is an important foundation for deterring environmental pollution in mines, ensuring national energy security and promoting sustainable development. In terms of legal forms, our country has initially formed the framework of legal system of mine environmental protection, but has not yet formed a perfect legal system of mine environmental protection. Based on the review and analysis of existing laws and regulations on environmental protection in mines and the comparison of the characteristics and advantages and disadvantages of different legislative models, this paper puts forward some preliminary opinions on how to perfect the legislation system of mine environmental protection in our country, that is, adding basic laws, revising related laws and improving supporting laws And repair methods.
