《中学政治教学参考·中旬》2016年第11期刊登了赵丽红老师撰写的《让法治教育从骨感走向丰实》一文(以下简称《赵文》)。《赵文》创设的模拟法庭情境,有利于调动学生学法用法的积极性与创造性,有利于培养学生法治能力、法治精神、法治思维。但是,《赵文》创设的模拟法庭情境存在以下问题:1.合议庭中缺人民陪审员,庭审中缺鉴定人、法警、书记员、被害人、法槌等。2.审判长未查明当事人是否都已到庭。确认双方当事人到齐后,由审判长宣布开庭。

However, the moot court situation created by Zhao Wen has the following problems: 1. lack of people’s jury members, lack of appraisers in court, bailiffs, clerks, victims, mallet, etc. in the collegial panel. 2. The presiding judge has not ascertained whether the parties have all been present. After confirming that both parties have arrived, the presiding judge announces the hearing.
