人文知识的两个特点对于法学知识的建构和运用有着重大意义:第一,研究对象(人)可受知识的诱导,形成知识的自我强化;第二,存在科学性方法失灵的领域。本文以著作权法为模型,揭示了前述问题的具体表现:其一,法学中的“偶然规律化”;其二,科学式演绎的失灵。法制史本应破解“偶然规律化”,但是过度科学化的研究方法反而使其加剧了这种现象。法学的创造性转向提供了解决之道:利用人的可塑性,发挥知识的创造力,策划理想生活,一方面可以避免历史偶然对现实的过度压制,另一方面摆脱寻找“科学式真理”的情结,创造解决方案。
The two characteristics of humanistic knowledge are of great significance to the construction and application of legal knowledge. First, the research object (person) can be induced by the knowledge and form the self-reinforcing knowledge. Second, there is a field where the scientific method fails. In this paper, the copyright law as a model reveals the concrete manifestation of the aforementioned problems: First, the “accidental law” in law; second, the failure of scientific deduction. The legal history should have solved “accidental regularization”, but the excessively scientific research method has actually exacerbated this phenomenon. The creative turn of jurisprudence provides a solution: using human plasticity, developing the creative power of knowledge, and planning an ideal life, on the one hand, we can avoid excessive over-repression of history by accident on the one hand and get rid of the complex of searching for “scientific truths” Create a solution.
