城镇住宅建设用地使用权70年期满后如何处理,影响着国家的稳定和社会的发展。《物权法》规定住宅建设用地使用权期满后可以自动续期,但未对续期的具体办法作出明确规定。本文在法律条文和立法价值分析基础上,从物权法的内涵着眼,结合公共政策角度,论证住宅用地使用权期满应该采取有偿续期。
How to deal with the right to use urban residential construction land after its expiration of 70 years will affect the stability of the country and the development of society. “Property Law” provides that after the expiration of the right of use of residential construction land can be automatically renewed, but did not make specific provisions for renewal. Based on the analysis of the legal provisions and the value of legislation, from the perspective of the connotation of the law of property and the public policy, this paper argues that the expiration of the right to use residential land should be paid for renewal.
