湖南省人民政府令第114号湖南省人民政府关于修改《湖南省林木、林地权属争议处理办法》的决定,已经1998年4月4日省人民政府第7次常务会议通过,现予发布施行。省长杨正午一九九八年五月四日省人民政府决定对《湖南省林木、林地权属争议处理办法》作如下修改:1、第十四条第二款修改为:“双方当事人协商解决不了的,由当地人民政府处理。全民所有制单位之间、集体所有制单位之间以及全民所有制单位与集体所有制单位之间发生的林木、林地所有权和使用权争议,由县级以上人民政府处理。个人之间、个人与全民所有制单位或者集体所有制单位之间发生的林木、林地所有权或者使用权争议,由当地县级或者乡级人民政府处理。”删去第十四条第三款。2、第十九条修改为:“当事人对人民政府的处理决定不服的,可以依法申请复议或者提起诉讼。”本决定自发布之日起施行。《湖南省林木、林地权属争议处理办法》根据本决定作相应的修正,重新发布。

Article 19 is amended as: ”If the parties are dissatisfied with the decision of the people’s government, they may apply for reconsideration or institute legal proceedings according to law." This decision shall go into effect as of the date of promulgation. The Measures for the Treatment of Forest and Land Ownership Disputes in Hunan Province shall be amended accordingly and reissued.
