农业保险法律关系是指农业保险法律制度在构建、规范和调整农业保险社会关系的过程所形成的国家和其他农业保险法律关系主体之间的“权力—责任”关系,以及其他农业保险法律关系主体彼此之间的“权利—义务”关系。研究农业保险法律关系是研究农业保险法律问题的基础。农业保险法律关系的主体是指在农业保险法律关系中拥有权利和权力,承担义务和责任的当事人,包括保险人、投保人、被保险人、国家和其他主体。农业保险法律关系的客体是指各主体在农业保险活动中的行为,是各主体之间权利—义务或者权利—责任关系的中介,是农业保险法律关系产生和存在的前提。农业保险法律关系的内容是指农业保险法律关系主体之间的权利—义务关系或者权力—义务关系。农业保险法律关系的产生,以农业保险合同生效为标志。农业保险合同当事人在合同有效期内对合同条款的变更,是农业保险法律关系的变更的原因。农业保险合同主体之间的权利义务关系的消灭引致农业保险法律关系的终止。
