在犯罪侦查实践中,由于侦查主体的自身思维定势或自身素质、侦查客体施加的干扰及侦查环境等方面的影响,使得相当一部分犯罪案件久侦难破,形成疑难案件,陷入侦查僵局。在这种现状下,对侦查僵局的成因进行研究,进而寻求解决侦查僵局的相应对策,突破僵局,化解疑难,就显得很有必要。本文主要从侦查僵局的概念特点、形成原因和突破对策三个方面入手,探讨一些可能的解决方法。
In the practice of criminal investigation, due to the self-determination of the investigating subject itself or its own quality, the interference caused by the detection of the object and the investigation environment, a considerable part of the criminal cases are hard to detect for a long time to form difficult cases and fall into the deadlock of investigation. Under such circumstances, it is necessary to study the causes of the detection deadlock, and then seek to solve the corresponding measures to detect the impasse, to break the impasse and resolve the problems. This article mainly from the concept of detecting the impasse characteristics, the formation of reasons and breakthroughs in three areas, to explore some possible solutions.
