随着我国教师惩戒权立法必要性与可行性的日渐凸显,教师惩戒权的立法设计问题应列入议事日程进行认真研究。该法可以作为《教育法》的一个下位法,以《教师惩戒条例》命名为妥。同时,在立法时应注意遵循预防性原则、双向性原则、权利与义务原则和协调性原则等。制定法律规则时要注意合理授予和调控自由裁量权以及防止把复杂问题简单化等倾向。
With the increasing necessity and feasibility of the legislation of teachers ’right of discipline in our country, the legislative design of teachers’ disciplinary rights should be included in the agenda for careful study. The law can serve as a subordinate law of the Education Act and be properly named after the Teachers’ Discipline Ordinance. At the same time, we should pay attention to the principle of precautionary principle, the principle of two-wayness, the principle of rights and obligations and the principle of coordination in legislation. When formulating legal rules, attention should be given to the tendency of rationally granting and regulating discretion and preventing the simplification of complex issues.
