本课题以《云南省花卉发展条例》与《植物新品种保护条例》的冲突为例,归纳了地方性法规与农业行政法规之间存在的隐性法律冲突,从制度内容、制度供给方面分析了地方性法规与农业行政法规产生冲突的原因,从我国立法法的相关规定入手详细分析了行政法规和地方性法规各自的立法权限,尤其是对“属于地方性事务”进行了全面深入的分析,提出了判定“地方性事务”的标准,并对规范我国农业立法活动提出了四个建议。
