通常我们在谈到中国传统法律文化中“礼治”思想的产生时,会将其归功于孔子。然而,经研究发现,“礼治”思想的主体来源于周公。周公“制礼作乐”不仅开创了中国礼乐文化之先河,也为中国儒家“礼治”法律思想奠定了基础。此外,周公确立的“德”以及“仁德政治”之观念亦成为中国传统法律文化中“德治”思想的起源。因而本文将着重介绍周公“德治”和“礼治”独创思想之产生,以昭示其对中国传统法律文化的启蒙意义。
Often we will credit Confucius when it comes to the emergence of the “Rule of Rites” idea in the traditional Chinese legal culture. However, the study found that the main body of the “Rule of Rites” comes from Zhou Gong. Zhou Gong “Making ceremony for music ” not only created a precedent for China’s ritual music culture, but also laid the foundation for Chinese Confucianism “Ritual ” legal thought. In addition, the notion of “morality” and “virtue politics” established by Zhou Gong also became the origin of the thought of “virtue governance” in Chinese traditional legal culture. Therefore, this article will focus on the introduction of Zhou Gong “moral governance ” and “ritual rule ” creation thought, in order to demonstrate its enlightenment meaning to Chinese traditional legal culture.
