“苏格拉底式教学法”(Socratic method),又称“案例教学法”(Case method),是英美法系国家最主要的教学方法。其特点是采用讨论式、对话式的教学方式,注重师生之间的互动与交流,鼓励学生对各种法律现象和法律问题进行深入的思考和探讨,重视对学生逻辑推理能力、分析问题和解决问题能力的培养。本文首先对“苏格拉底式教学法”的起源、特点及运用进行了分析,继而就“苏格拉底式”教学法对我国法学教育的影响进行了探讨。
Socratic method, also known as Case method, is the most important teaching method in Anglo-American countries. It is characterized by discussion-based and conversational teaching methods, paying attention to the interaction and exchange between teachers and students, encouraging students to think and discuss various legal phenomena and legal issues in depth, attaching importance to students' logical reasoning ability, analyzing problems and Ability to solve problems. This paper first analyzes the origin, characteristics and application of “Socratic teaching method”, and then discusses the influence of “Socratic teaching method” on legal education in our country.
