检察机关参与环境公益诉讼,对于保护环境公共利益和公民权利是必要的。在目前的司法实践中,检察机关参与环境公益诉讼的主要途径是直接提起诉讼,但这一介入方式尚不能满足现实的需求。根据具体情形我们可以考虑选择检察机关支持公益诉讼或者运用检察建议督促起诉的方式参与诉讼。
Procuratorial organs to participate in environmental public interest litigation, for the protection of the public interest in the environment and civil rights are necessary. In the current judicial practice, the main way for the procuratorial organs to participate in environmental public interest litigation is to directly bring litigation, but this method of intervention can not meet the realistic needs. Depending on the circumstances, we may consider choosing a prosecutorial organ to support a public interest litigation or using prosecutorial advice to supervise the prosecution.
