国际标准钻井合同的框架结构包括主要条款(General Conditions)及附属条款(Schedule)。主要条款部分明确了钻井作业服务的范围、各方责任及权利、付款方式、保险、税务及法律条款以及争议的解决等;附属条款则详细列明作业方应提供的设备及人员条件,与钻井作业相关的一些材料及服务的要求等。本文我们就AIPN和LOGIC钻井服务合同的主要条款进行了比较,对各方的责任和权利、免责、不可抗力等关键条款进行了分析,并结合日常工作经验,提出了一些建议和想法。
The framework of the international standard drilling contract includes the General Conditions and the Schedule. The main clauses specify the scope of drilling operation services, responsibilities and rights of all parties, methods of payment, insurance, tax and legal provisions, and settlement of disputes. The subsidiary clauses specify the equipment and personnel conditions to be provided by the operator, Job-related materials and service requirements. In this paper, we compared the main clauses of the AIPN and LOGIC drilling service contracts, analyzed the key terms such as responsibilities and rights, disclaimer and force majeure of the parties, and put forward some suggestions and ideas based on the daily working experience.
